Air Canada Faces $250,000 Penalty from U.S. for Iraqi Airspace Violations

The U.S. Department of Transportation has fined Air Canada $250,000 for violating safety policies by operating flights over Iraqi airspace. The violations occurred due to an air-sharing agreement with United Airlines, which allowed United Airlines' aircraft to be used for Air Canada flights.

The violations took place between October 2022 and January 2023. During this period, Air Canada operated several flights that breached a Federal Aviation Administration (FAA) ban. The FAA prohibits U.S. airlines from flying over Iraqi airspace for safety reasons. This ban has been in place for years due to the high-risk conditions in the region.

Iraqi airspace has been classified as dangerous due to military conflicts and political instability. Numerous aviation authorities worldwide have imposed similar bans to protect passengers and crew. The increased risk of military conflicts and missile launches in the area contributes to these restrictions.

The FAA ban applies to U.S. airlines and their partner companies. It affects all aircraft, whether registered in the U.S. or operated under code-sharing agreements. As per the U.S. Department of Transportation's investigation, Air Canada operated a "significant" number of flights between Dubai and Canada. These flights utilized a Boeing 777-300, which resulted in longer flight times and the violation of Iraqi airspace. Typically, Air Canada uses a Boeing 787 for this route, which has different performance characteristics.

Air Canada stated that the change in aircraft was due to operational needs. The airline described the violations as "unplanned, unintentional, limited in number and short duration." Despite this, the U.S. Department of Transportation clarified that Air Canada violated its operating license terms. This license requires compliance with U.S. safety regulations.

As a result of the investigation, the U.S. Department of Transportation imposed a $250,000 fine. This penalty was officially announced on September 27, 2024. Air Canada agreed to pay half of the penalty within 60 days as part of a settlement. The remaining amount will be suspended if the airline avoids further violations in the next 12 months.
